Causing death by dangerous driving or careless driving
If you have caused the death of another person through driving, then you have committed the criminal offence the offence of:
- Death by dangerous driving or
- Causing death by careless driving or
- Causing death by careless driving while under the influence of drugs or drink driving
Death by dangerous driving
This is a very serious offence which can carry a prison sentence of up to 14 years. A mandatory disqualification of at least 2 years will be imposed and you will be ordered to retake a driving test before your driving licence is returned to you. You will also face an unlimited fine.
Causing death by careless driving
This offence carries a maximum prison sentence of 5 years in the Crown Court, a maximum sentence of up to 6 months imprisonment in the Magistrates Court and an unlimited fine. You will be disqualified from driving for a minimum of 12 months with a discretionary re-test and liable to 3-11 points being endorsed on your licence.
Causing death by careless driving whilst under the influence of drink or drugs
A maximum prison sentence of 14 years with an unlimited fine, two year disqualification and extended retesting when applying for a new licence can be imposed.
